In more formal settings such as court appearances, I am Ms. Mamlyuk (pronounced as in “mum” and “luke” but please feel free to just call me Alina).
First and foremost, I am a federal litigator, handling legal disputes and appeals in United States federal courts.
In copyright matters, my clients include independent artists (photographers, filmmakers, content creators) who are navigating the complex world of intellectual property. I have guided clients through media channel disputes and buy-outs (YouTube, Instagram) to resolve issues through settlement. Likewise, I have represented my clients in suing for copyright infringement, taking on established media giants (Disney) when pre-suit settlement discussions did not resolve disputes. I am more than comfortable in litigating matters against large corporate entities on behalf of plaintiffs of any size.
I also represent clients in complex bankruptcy litigation, particularly in adversary proceedings and in bankruptcy appeals. I represent Chapter 11 and Chapter 7 trustees, creditors, and debtors. This includes representation of my clients in California state courts pertaining to property disputes and state appeals. In one of my current cases in which I represent the Chapter 11 Trustee (joint representation through Marshack Hays Wood LLP and Dinsmore & Shohl LLP), my client has initiated more than 200 adversary proceedings in a single bankruptcy case (In re The Litigation Practice Group P.C.), seeking to avoid and recover nearly $300 million in avoidable transfers, of which the entered settlements already total over $17 million. For context, most bankruptcy matters involve one to two adversary proceedings, if any. In this matter, I was particularly involved with investigations of administrative claims and fraudulent transfers, advising my trustee client on appropriate course of action dependent on results of said investigations.
In my appellate practice, I represent clients in state appeals, district court appeals from the bankruptcy courts, and in matters taken to the Ninth Circuit Court of Appeals. In other words, I handle matters from pre-suit negotiations to any appellate route that the case may take. As my clients can attest, I am more than capable of working alone on multi-million-dollar assignments and, at the same time, I thrive in collaborating on large cases involving multiple firms.
Additionally, I assist tenants in disputes with landlords, and residents in disputes with HOAs. I particularly loathe the abusive practices that are often employed in misleading tenants and residents of their rights as it concerns dangerous living conditions.
Whenever I have the opportunity to bring my litigation skills and experience to my tenant and resident clients, I find that disputes become more narrowed to the actual legal issues at hand and, most importantly, my clients feel heard and seen, which allows the disputes to be quickly resolved.
